3. User Workspaces and Registration

Workspace Creation

• You must be at least 16 years old to create a workspace
• You must provide accurate and complete information
• You are responsible for maintaining workspace security
• You may not share your workspace credentials

Workspace Responsibilities

• Keep your login credentials secure and confidential
• Notify us immediately of any unauthorized access
• Ensure all workspace information remains current and accurate
• You are liable for all activities under your workspace

4. Acceptable Use Policy

Permitted Uses

You may use Murmurly for legitimate event management and collaboration purposes in compliance with all applicable laws.

Prohibited Activities

• Uploading malicious software or harmful content
• Violating any laws or regulations
• Infringing on intellectual property rights
• Harassing, threatening, or abusing other users
• Attempting to gain unauthorized access to our systems
• Using the service for illegal events or activities
• Spamming or sending unsolicited communications
• Reverse engineering or attempting to extract source code

5. Real-time Collaboration Terms

Collaborative Content

• Content you create is visible to other authorized collaborators
• Changes are synchronized in real-time across all connected devices
• You are responsible for content you contribute to shared events
• Collaboration history may be maintained for audit purposes

Shared Responsibility

• All collaborators share responsibility for event content accuracy
• Respect other collaborators' contributions and intellectual property
• Maintain professional conduct in all collaborative interactions
• Report inappropriate behavior or content violations

6. Content and Intellectual Property

Your Content

• You retain ownership of content you create
• You grant us a license to host and display your content
• You represent that you have rights to all content you upload
• You are responsible for backing up your important content

Our Intellectual Property

• Murmurly platform and technology remain our property
• Our trademarks, logos, and branding are protected
• You may not copy, modify, or distribute our software
• Any feedback you provide may be used to improve our services

7. Payment Terms

• Subscription fees are charged in advance
• Payments are non-refundable except as required by law
• We may change pricing with 30 days' notice
• Workspaces may be suspended for non-payment
• You are responsible for all applicable taxes
• Auto-renewal can be canceled at any time

8. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Service Availability and Support

Service Level

• We strive for 99.9% uptime but cannot guarantee uninterrupted service
• Scheduled maintenance will be announced in advance when possible
• We provide customer support during business hours
• Emergency support is available for critical issues

Data Backup and Recovery

• We maintain regular backups of your data

12. Termination

Termination by You

You may terminate your workspace at any time by contacting our support team or using the workspace deletion feature in your settings.

Termination by Us

• We may suspend or terminate workspaces for Terms violations
• We may discontinue the service with 30 days' notice
• Immediate termination may occur for serious violations
• Upon termination, your right to use the service ceases immediately

13. Dispute Resolution

We encourage resolving disputes through direct communication. If that fails:

• Disputes will be resolved through binding arbitration
• Arbitration will be conducted under the rules of the American Arbitration Association
• The arbitration will take place in San Francisco, California
• Class action lawsuits are waived

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the service. Continued use after changes become effective constitutes acceptance of the new Terms.

15. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.
